Consider the following statements with reference to the Constitution of India:

  1. There is no Article in the Constitution of India that specifies that the Constitution of India will be officially called the ‘Constitution of India’.
  2. There is no Article in the Constitution of India that specifies that the Indian Independence Act, 1947 and the Government of India Act, 1935 stand repealed.
  3. There is no Article in the Constitution of India that mentions 26th January, 1950 as the date of the commencement of the Constitution of India.
Show the answer and explanation

Answer: (b) There is no correct statement.

All three “there is no Article” claims are false: Art. 393 names it, Art. 394 fixes 26 January 1950, Art. 395 repeals the 1935 and 1947 Acts.

Statement by statement

1. ✗ WRONG — Article 393 Article 393 (Short title): “This Constitution may be called the Constitution of India.”

2. ✗ WRONG — Article 395 Article 395 (Repeals) repeals the Indian Independence Act, 1947 and the Government of India Act, 1935 (with its amending Acts). The Abolition of Privy Council Jurisdiction Act, 1949 was left alone.

3. ✗ WRONG — Article 394 Article 394 (Commencement): a few Articles (citizenship, elections, provisional Parliament…) came into force on 26 November 1949; the rest on “the twenty-sixth day of January, 1950, which day is referred to in this Constitution as the commencement of this Constitution”.

The idea

Part XXII (Articles 393–395) is the Constitution’s own “front door”: its name, its start date and the laws it replaces. Some provisions began on 26 Nov 1949 (Art. 394 lists them); the rest on 26 Jan 1950. The official 2026 key comes after the final result; this is our answer.

Art. 393 · name → Art. 394 · commencement → Art. 395 · repeals 1935 + 1947 Acts

Why the others are wrong

(a) Would mean the Constitution never names itself, never repeals the old Acts and never fixes its start date. It does all three, in Articles 393, 394 and 395.

(c) Statement 3 is the most tempting because people remember 26 January from history, not from an Article. But Art. 394 states the date in words.

(d) No single statement survives: each one is contradicted by one of the last three Articles.

The trap

The “there is no Article…” wording makes a false statement sound like a safe negative. Read each one as a claim you have to check.

🔒 Part XXII: 393 = short title · 394 = commencement (26 Jan 1950; some parts 26 Nov 1949) · 395 = repeals GoI Act 1935 + Indian Independence Act 1947.
